Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://nzcam.net and the NZCAM account, credits, billing and download services (together, the "Services"). Use of the NZcam desktop application itself is governed by our End User License Agreement.

1. Accounts and sign-in

You must be 18 or older to create an account. You can sign in with your email or username and password; when you sign in on a new device we email you a one-time code to confirm it's you. You are responsible for keeping your credentials confidential and for all activity under your account. You may be signed in on one device at a time; signing in elsewhere signs out the previous device.

2. Free trial and watermark

Every NZcam app (Lite and full, on each supported operating system) is free to download and try. In the free tier, output carries a watermark. A paid plan or credits for that app type removes the watermark; they do not add features.

3. Credits, plans and billing

Paid access is credit-based. Credits are consumed only while you are live (metered per second), or you can choose an Unlimited plan for a fixed period. Current prices are always shown in the pricing section on our home page and are the authoritative amounts. Payments are processed by Flutterwave, which accepts cards and, in supported countries, bank transfer. We never see or store your full card details or your bank credentials. Timed credit packs expire at the end of their period; top-up credits do not expire.

Recurring charges only if you set one up. Nothing on NZcam auto-renews by default. If you enable Auto top-up you authorise us to charge your saved payment method for your chosen amount when your balance runs low. Where you set up a bank direct debit, you authorise charges within the limits shown on the mandate you approved with your bank — up to the stated maximum amount per charge, and no later than the expiry date on the mandate. You can cancel either from your billing page, and a direct debit mandate can also be cancelled through your bank. See our Refund Policy.

4. Your content, and who owns the output

You own your input, and you own your output. The photos, video and audio you supply remain yours, and we claim no ownership of anything NZcam produces from them. We do not acquire a licence to your media, we do not use it to train models, and — because core face swap and voice change run entirely on your own computer — in the ordinary case we never receive it at all. You are responsible for the content you create and for having the rights and consents needed to create it. You confirm that your use of any person's face, likeness or voice complies with our Acceptable Use Policy and with the law where you are.

5. What AI output is, and is not

NZcam produces synthetic media using machine-learning models. Output can be inaccurate, distorted, or unflattering; it can reflect bias present in training data; and it is not guaranteed to be unique — other users giving similar input may receive similar output. Output is not a factual record of anything, and must never be presented as authentic footage of a real person or event. You are responsible for reviewing output before you publish, broadcast or rely on it, and for any consequence of doing so.

6. Feedback

If you send us suggestions, feature requests or bug reports, you grant us a perpetual, worldwide, royalty-free right to use them to improve NZcam, with no obligation to compensate you and no obligation to keep them confidential. This covers the idea only — it gives us no rights in your media, your account data, or anything else you own.

7. No refunds

All purchases (credits, plans and top-ups) are final and non-refundable once completed. Because you can try every app free (watermarked) before buying, please make sure a purchase is right for you first. This does not affect rights that cannot be waived under applicable law.

8. Downloads and licensing

Downloads are open to everyone and require no account or purchase. An active plan or balance grants you a node-locked right to run the app watermark-free per our EULA, on one machine at a time, movable by signing in on another machine.

9. Acceptable use

Use of the Services must comply with our Acceptable Use Policy. We may suspend, lock or remove an install, or terminate an account, that violates it, that we reasonably believe is being tampered with, or that is used to redistribute or reverse-engineer the software.

10. Availability

We aim for high availability but don't guarantee the Services will be uninterrupted or error-free. Planned maintenance or unforeseen issues may cause temporary downtime.

11. Changes to the Services and pricing

We may modify, update, or discontinue features over time. Prices are set server-side and may change; the price shown at checkout is the price you pay for that purchase.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your account for violations of these Terms or the Acceptable Use Policy. Unused credits have no cash value and are not refundable on termination.

13. Disclaimers and limitation of liability

The Services are provided strictly on an "as is" and "as available" basis. To the fullest extent permitted by Nigerian law, including the Federal Competition and Consumer Protection Act (FCCPA) 2018, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be secure, uninterrupted, or free of errors or harmful components.

To the maximum extent permitted by applicable law, NZCAM, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Services. Our total aggregate liability for any claim relating to the Services shall not exceed the greater of (a) the total amounts paid by you to us in the twelve (12) months preceding the claim, or (b) NGN 50,000. Nothing in these Terms limits our liability for death or personal injury resulting from our negligence, fraud, or any statutory rights that cannot be contracted away under the FCCPA.

14. Indemnity

You agree to indemnify and hold harmless NZCAM, its officers, employees and contractors against any third-party claim, demand, loss or expense (including reasonable legal fees) arising from content you create with NZcam, your breach of these Terms or the Acceptable Use Policy, or your infringement of anyone's rights — including rights in their likeness, voice, privacy or intellectual property. We will notify you of any such claim and you may assume its defence with counsel we reasonably approve; you may not settle any claim in a way that imposes an obligation or admission on us without our written consent. This does not apply to the extent the claim arises from our own breach or negligence.

15. Third-party and open-source components

NZcam includes open-source and third-party components, each distributed under its own licence. Where such a licence conflicts with these Terms, that licence governs that component. The notices and licence texts ship with the application. Third-party services we rely on — our payment processor, our infrastructure providers, and the AI processing partner behind cloud-powered features — have their own terms and privacy policies, and we are not responsible for how they operate their own services.

16. Export controls and sanctions

You may not use the Services, or permit anyone else to use them, in breach of applicable export control or sanctions laws. You confirm you are not located in, ordinarily resident in, or acting on behalf of a country or person subject to comprehensive sanctions that would prohibit us from supplying the Services to you.

17. Force majeure

Neither party is liable for failure or delay caused by events beyond its reasonable control — including power or network failure, failures of an upstream provider, natural disaster, epidemic, armed conflict, civil unrest, industrial action, or government action. This does not excuse any obligation to pay amounts already due.

18. Assignment

You may not assign or transfer these Terms, or your account, without our written consent. We may assign them to an affiliate or to a successor in connection with a merger, acquisition or sale of assets, provided the recipient assumes our obligations to you.

19. Severability, waiver and entire agreement

If any provision of these Terms is held unenforceable, it is limited or severed to the minimum extent needed and the remainder stays in force. Our failure to enforce a provision is not a waiver of it, or of any other provision. These Terms, together with the EULA, Privacy Policy, Acceptable Use Policy, Refund Policy and Cookie Policy, are the entire agreement between us about the Services, and replace any earlier understanding on the same subject.

20. Survival

Sections 4 (your content and outputs), 5 (AI output), 6 (feedback), 7 (no refunds), 13 (disclaimers and liability), 14 (indemnity), 16 (export), 19 (severability and entire agreement), this section, and 21 (governing law) survive termination of your account, along with any other provision that by its nature is intended to survive.

21. Governing law and disputes

These Terms, and any disputes arising out of or connected with them (including non-contractual disputes), shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. You agree to submit to the exclusive jurisdiction of the courts located in Lagos State, Nigeria, to resolve any legal matter arising from the Services.

Before filing anything, please contact us — most disputes, and nearly all billing disputes, are resolved faster directly. Nothing here prevents either party from seeking urgent injunctive relief, or removes any right you have to complain to a regulator or to bring a claim in a consumer forum available to you under a law that cannot be contracted away.

22. Changes to these Terms

We may update these Terms from time to time, and we'll update the "Last updated" date above when we do. For changes that materially reduce your rights or increase your obligations, we will give you at least 14 days' notice — by email to your account address, or by a notice in the app or on this site — before they take effect. Continuing to use the Services after that means you accept the change; if you don't, stop using the Services and tell us, and we will close your account.
